Roadhouse Collectable Auctions (RCA) — Terms & Conditions
Part 1: All Lots (Part 2 – Vehicles: below)
Binding Bids & Account Responsibility: All bids are final and binding. By bidding, you agree to purchase any lot you win, subject to these terms. Bidders are responsible for all activity under their account. Accidental bids, internet issues and device errors do not entitle bidders to cancel bids.
Buyer’s Premium: Buyers premium added to winning bids: 16.5% for collectables and all non-vehicle lots, and 9.35% for vehicles including motorbikes. Both rates include GST on commission payable. No GST applies to the items.
Payment & Non-Payment: Full payment is due within 3 days of the auction’s conclusion. Unpaid invoices may result in HiBid account suspension and recovery action.
Condition & Descriptions: All lots are sold as-is, without warranty or guarantee except as required by law. Before bidding, buyers must review photographs and descriptions and satisfy themselves as to condition and suitability, including by inspection and independent advice where appropriate.
Pickup & Shipping: Pickup is available, and RCA can assist with posting, shipping and couriers. Buyers are responsible for all freight and insurance costs. Large lots must be collected in person or by a courier arranged by the buyer. Vehicle collection is covered in Part 2.
Auction Disruptions: RCA may suspend or close an auction where technical problems or other issues affect its fair or proper conduct. Affected lots will be reoffered at a later date, with bidders notified of revised arrangements.
Auction Decisions: RCA may withdraw any lot before sale and determine the successful bidder in a bidding dispute, subject to applicable law.
Part 2 – Vehicles:
We love old cars, but they’re old cars. Please read this before you bid.
- Bids are final. Every winning bid is binding. If you’re unsure, don’t bid.
- Information comes from the consignor. We work hard to describe each vehicle accurately and provide many photographs. But the details come from the consignor, we don’t drive these cars any real distance, and photos can’t show everything.
- Inspect before you bid. It’s your responsibility to inspect the vehicle, or have someone inspect it for you, and decide its condition for yourself. Independent inspections are welcome and encouraged. We’re an auction house, not experts on every make and model.
- Sold as-is. All vehicles are sold at auction, unregistered and without warranty. There is no cooling-off period. The required Form 11 auction notice is provided with every vehicle.
- Odometers. Readings are as displayed on the vehicle. We make no representation as to accuracy unless we say otherwise.
- Compliance and modifications. Some vehicles may be modified, or may not have been registered in Australia before. Check with your engineer or road authority what registration will require, and allow for those costs before bidding.
- Before you drive it. A car that may have been sitting for a while needs attention. Change the fuel, oil, fluids and filters, and have the brakes inspected by a qualified mechanic before road use. Of course, where we know of an obvious issue, we’ll point it out in the listing.
- Payment. Payment is due within 3 days of the auction closing, by EFT or cash. If payment is late, interest of 25% per annum applies from the due date until paid in full. Unpaid vehicles may be re-offered, and the buyer will be liable for any shortfall and recovery costs.
- Collection and storage. Vehicles must be collected within 5 working days of payment (unless pre-arranged with RCA) and are released on proof of payment. After that period, a storage fee of $150 per day applies. Floor space in our showroom is what we trade on, and every day a car remains is space we can’t use for the next consignment, plus the cost of securing, insuring and handling it.
- Risk and insurance. The vehicle is your responsibility from the fall of the hammer, including insurance. Please ensure you action this point and obtain adequate cover for your vehicle.
Statutory Rights: Nothing in these terms excludes, restricts or modifies any rights, guarantees or remedies that cannot lawfully be excluded.
